We are indeed very happy to see that an important matter raised by an IFA on our Discussion Forum, which we took up with AMFI's ARN Committee, has resulted in SEBI and AMFI working together to provide the necessary clarification and relief to IFAs across the country.

Ms. T V Savithri from Hyderabad had created a discussion thread in Dec 2012 where she sought to know what would happen to trail commission in case of death of an ARN holder

A number of fellow IFAs expressed concern on this issue and accordingly, Wealth Forum forwarded this query to AMFI's ARN Committee (headed by Harshendu Bindal, CEO, Franklin Templeton) for consideration.  The AMFI committee responded to us in Jan 2013 that they have taken up the matter with SEBI.

We now have a circular from AMFI which clarifies the position and provides much needed relief to our senior citizen IFAs that their trail commission will continue to be paid to their nominees, even if the nominees are not ARN holders themselves.

I humbly request all to please use this forum in a constructive and solution oriented manner.  Please do raise any issue that you think needs the industry's attention - but please be balanced in the language you choose.  Where possible, please offer solutions that you think will work - this will help all concerned to evaluate options and decide the best way forward.

What I understand that the nominee will get the trail commission after the death of ARN holder. But what ? if an ARN holder, after working for some years, leaves the profession for any reason whatsoever. Should not the trail commission be continued to paid.? The trail commission is for the business done by an ARN holder in the past. So he/she is entitled to receive it as long as the investment remains with the AMC. Please clarify.

OFF LATE MANY AMCS HAVE STARTED INFORMING IFAS THAT NO TRAIL WILL BE PAID INSPITE OF SIPS RUNNING UNDER THEIR ARN NOS. AS NO ADDITIONAL BUSINESS HAS BEEN PROCURED. REASONS FOR SUCH FAILURE IN LOGIN ARE DUE TO THE FACT THAT SERVICING TO ALL AMCS BY AN INDEPENDANT IFA IS HARDLY POSSIBLE & HAS SHIFTED BASE AS A SUB-BROKER WITH SOME INSTITUTIONAL IFA. HOW CAN THE TRAIL BE STOPPED? IN MY CASE HSBC HAS SHOOTED SUCH LETTER TO ME. ANY GUIDANCE ON THIS COUNT BY SEBI / AMFI?

Thanks for the information. But if I am right the nomination facility is in existance since 2004 and that means the commissions due to the ARN holders are to be paid to the nominee on his death. Novertheless you have made it more clear for the IFAS to know. THE BASIC FACTOR THAT REMAINS TO BE FULLY CLARIFIED IS WHETHER THE SR. IFAS WHO MAY NOT BE ACTIVE BECAUSE OF VARIOUS REASONS WILL CONTINUE TO GET THE DUE COMMISSIONS TILL THEY ARE ALIVE OR TILL THE FOLIOS CANVASSED BY THEM REMAINS VALID. Regards NAIK

What about if some one( may be an senior citizen or by other compulsion) decided to quit mutual fund business after some years of working,whether he/she still be entitled for trail on hi/her AUM still with industry? He/She had worked hard for the industry & industry will still be earning on his/her AUM by fees ( management fess etc...). Should trail be paid or not? Raise/post this question.

Great work.Still Miles to Go.Lot of Pending Work like Simpification of KYC, ( too many KYC agency,no interconnection between them no sharing of data, highlight to AMFI comittee)Simpification of Updation of Bank update ( common procedure for all AMC),There are still few Issues to be Solved.I Expect Wealth Forum will act fastly to highlight and try to slove with the help of AMFI Committe. Lets hope that Client wont get harasse in New Financial Year by SEBI & AMFI

i have registered with some m/f directly and some through by my company and other brokers. i am not understand that why every three year exam is conducted for IFA WHERE as for doctors/lawers/c.A. no examination conducted where as they directly hit the comman man. 2ndly Amfi charge both fees from me for my individual as well corporate and issued the card & registration for one why It is clearly indicate that either they have no norms or their officer have no knowledge about the procedure third registation also given part period where as they charge for full period

Thanks to Wealth Forum, AMFI Committee, Mr. Bindal of FT and V.Ramesh of AMFI. The harsh language used by IFAs (sometimes by me also) is not good, but simple and logical things were not happening and no body was listening therefore the frustration came out loud. Still simple issue unaddressed is "WHY ARN RENEWAL IS NOT HAPPENING FROM THE DATE OF ITS VALIDITY ?" No debate, no thinking is required for this simple issue. But a clarification will come only after frustration comes on such forums very loudly.

Thanks to Ms. T. V. Savithri, the IFA from Hyderabad who first raised this query. Now that the clarification has come and no body is left in doubt. Secondly, as Mr. Anat from Surat has pointed out, Trail should continue if any IFA is not able to renew his ARN maybe due to poor health or for any other personal problem in the family. Thirdly, renewal charges for ARN card have been increased drastically from Rs.500 to Rs.1,500. Mr. S. K. Budhia from Ranchi has rightly mentioned that inflation has not risen so sharply. I sincerely hope AMFI will reconsider the increase in charges and be a little reasonable. Lastly the validity of the ARN card should be for 5 years as it was earlier. It is my humble request to AMFI to maintain the same validity of 5 years for the ARN card, as in the past. Thanks and best regards.

Last month through this column I wrote that there should be retirement for senior IFAs in which case they must get trail,why wait for death of IFAs. Some senior IFAs cannot do business due to handicap due to age.This must be discussed at an earlier meeting with AMFI and SEBI.

Very happy to hear a great news. I am more happy to know that AMFI and SEBI hear our voice through you. Hope you shall start raising many pending issues by sending queries to them, for example different type of formalities by all AMCs , different types of forms, different interpretations etc. Everything should be tuned in one pattern (should be streamlined) so Advisors can spare more time after educating themselves for increasing required knowledge rather than to spend time after learning and remembering non productive things. Certainly, it comes as a sweet news and rather incredible. Thanks to SEBI and AMFI. There is a popular saying - one sunny day does not make a summer. I do hope that the regulators understand the value of professional IFAs and encourage them . Financial Intermediaries are a must in a country like ours with 1.3 billion population and unless they are encouraged, the majority would move out . Sustenance factor is very important.
